We told in our last article that we will talk about the accidents related to the nuclear power plants, the levels of the accidents and the consequences of the legal liability. We will keep our promise; on the other hand, today there is another topic to talk about.

Representatives of the private and the public sectors, who are specialized on the international nuclear law, met in Argentina on October.
21st General Assembly of the International Nuclear Law Association, that took 3 days, placed in Buenos Aires which is the most famed town of the South America.

In the assembly, which approaches the recent developments on the nuclear energy law, the main topics were safety issues as mainly, security and third party liability and their progression in Europe and other states.

Almost all of the topics that came up in the event were related to Turkey in fact that Turkey has just started to form its legal structure regarding nuclear energy law. However, the speech topic of Rosatom, which is planning to establish the nuclear power plant of Mersin Akkuyu, was directly in relation with Turkey.

The point of view to the nuclear energy in the world stays the same except Germany in spite of the negativities that may occur sometimes, Turkey, which is one of the newest participants of the nuclear market, is the attention-grabbing state with 2 different nuclear power plants placed in Mersin Akkuyu and Sinop.

The subject of the speech of Rosatom’s Ilya Smirnov, who is the representative of the Akkuyu Nuclear AS which is the first nuclear power plant of Turkey as mentioned, was the legal situation of the build-own-operate (BOO) model nuclear power plants, in the event. In fact, the summary of the Smirnov’s speech was consisting of Turkey’s being unprepared in the legal aspects.

The Russian company has felt the necessity to express their concerns on an international platform although they enter into the market by knowing the fact that they will establish the first power plant of Turkey.

Smirnov underlined that Turkish side doesn’t take any responsibility regarding the nuclear investment. Smirnov also added that all the responsibilities including financing are left to the Russian side.

According to Smirnov, the main problem is the formation of the structure of the legislation on the nuclear energy law because of the Turkey’s being a new participant to the market. He additionally mentioned the problems arisen of the fact that Turkey hasn’t got any experience on licensing. Russian representative told about Turkey’s insistence on Turkish staff as mainly, the difficulties to be faced on the practice of the legal provisions and the point of view of Turkish people to the nuclear energy.

Actually, discussion on the conformity of Mersin Akkuyu for the establishment of the nuclear power plants is not new. The cooperation has just succeeded with Russian government after the decisions taken by Turkish government on the specific conditions for the place, which was licensed in 1976. Since, the first nuclear power plant has practically started to be formed by the agreement of 2010, so far, the structure of such issue has been forming by the national and international bodies. With this respect, it is surprising that Russian company’s complain on Turkey’s being new and inexperienced in the market.

After accidents of Chernobyl and particularly Fukusima which occurred recently, the expectation of allowing a state or a foreign company to establish a nuclear power plant without any restriction with employment of foreign staff and law, from Turkey cannot be considered as legitimate.

Of course, the most appropriate way is amendment of the local law in accordance with the international law after a detailed study for Turkey as a new member in the market. And, it is what happens now.

When we take a look at the latest progress regarding the establishment of Mersin Akkuyu power plant, Akkuyu Nuclear AS has obtained the Environmental Impact Assessment Report. However the license of construction is still waiting to be provided.

As it seems, completion of the legal structure regarding the nuclear energy law is just important as the establishment of the plants.

DÜNYANIN ÖTEKİ UCUNDA AKKUYU TARTIŞMASI!

Ruslar, ilk nükleer santralini kurmaya hazırlandıkları Türkiye’nin bu alandaki hukuki gelişimlerini uluslararası camiada masaya yatırdı...

Bundan önceki son yazımızda, bir sonraki yazıda nükleer santral kazaları, bu kazaların seviyeleri ve bunun hukuki sonuçlarını ele alacağımızı söylemiştik. Sözümüzü elbette tutacağız, ancak bugün başka bir konudan bahsetmek istiyoruz.

Uluslararası alanda nükleer enerji hukuku üstüne uzmanlaşmış kamu ve özel sektör temsilcileri, geçtiğimiz Ekim ayında Arjantin’te buluştu.
Üç gün süren 21. Uluslararası Nükleer Hukuk Birliği Genel Kurulu, Güney Amerika’nın tanınmış kenti Buenos Aires’te yapıldı.

Nükleer enerji hukuk alanındaki gelişmelerin ele alındığı konferansın tartışma konuları, başta güvenlik, emniyet ve üçüncü taraf sorumluluğu ile Avrupa ve dünyada bu alanda yaşanan gelişmelerden oluşuyordu.

Etkinlikte gündeme gelen konuların hemen hemen hepsi de, nükleer hukuk alanındaki düzenlemelerini yeni oluşturmaya başlayan Türkiye’yi yakından ilgilendiriyordu. Fakat Mersin Akkuyu nükleer santralinin kurulumunu gerçekleştirecek olan Rosatom’un konuşma konusu ülkemizi doğrudan ilgilendirmekteydi.

Dünyada nükleere bakış acısı zaman zaman yaşanan olumsuzluklara rağmen Almanya hariç ciddi bir değişikliğe uğramazken, Nükleer pazarın en yeni katılımcılarından Türkiye, Mersin ve Sinop’taki 2 ayrı nükleer santralle birlikte dikkatleri üstüne çeken ülke oldu.

Konferansta Türkiye’nin ilk nükleer projesine imza atmaya hazırlanan Akkuyu Nükleer AŞ’nin temsilcilisi, Rosetom’dan İlya Smirnov’un konuşma konusu BOO (build-own-operate) model nükleer santrallerin hukuki durumuydu. Smirnov’un konuşmasının özeti, aslında Türkiye’nin hukuki anlamda nükleer santrale ne kadar hazırlıksız olduğunu anlatmaktan ibaretti.

Her ne kadar Rus firma Türkiye’de ilk nükleer santrali kendilerinin kuracaklarını bile bile pazara giriş yapsa da bu konudaki endişelerini uluslararası bir platformda gösterme gereği duydu.

Firma yetkilisi, Türk tarafının nükleer yatırım konusunda hiçbir şekilde elini taşın altına koymadığının altını çizdi. Smirnov, finansman dâhil olmak üzere her türlü sorumluluğun Rus tarafına bırakıldığına işaret etti.

Smirnov’a göre Türkiye’nin pazara yeni girmesinden dolayı nükleer hukuk altyapısının yeni oluşturulması başlıca problem. Smirnov, Türkiye’nin özellikle lisanslama konusunda hiç deneyimi olmayışından kaynaklı sıkıntıların da altını çizdi. Smirnov, başta Türk personelde ısrar edilmesi olmak üzere, yerel kanun koyucuların getirdiği kuralların uygulanmasının güçlüklerinin yanı sıra, halkın nükleere bakış açısının da sıkıntılı olduğundan söz etti.

Aslında Mersin Akkuyu sahasının nükleere uygunluğu tartışması, yeni bir olgu değil, 1976 yılında lisanslandırılmış yer için, diğer şartlar, hükümetin bu yönde aldığı kararlar sonucunda Rus hükümeti ile işbirliği içerisinde ancak yeni yerine getirilebildi. Zira ülkenin ilk nükleer santrali pratik olarak 2010 yılındaki anlaşmayla başladı. Ve o gün bugündür bunun alt yapısı ulusal ve uluslararası organlarca oluşturulmaya çalışılıyor. Bu yüzden Rus menşeili şirketin Türkiye’nin pazarda yeni olmasından ve özellikle tecrübesizliğinden şikâyet etmesi şaşırtıcı.

Çernobil ve özellikle yakın zamanda yaşanan Fukusima kazasından sonra ülkeye sorgusuz sualsiz yabancı bir devletçe nükleer santral yapılmasına izin verileceği, yabancı hukuk ve yabancı personel çalıştırılmasına izin verileceği beklentisi çok yerinde olmazdı.

Pazarda yeni olan Türkiye için en uygunu tabi ki uluslararası düzenlemelerin iç hukuka çok detaylı inceleyerek alınmasıdır. Şu anda yapılan da budur.

Türkiye’de ilk nükleer santralin, yani Akkuyu Nükleer Güç Santrali’nin kuruluşuyla ilgili son duruma bakacak olursak, Akkuyu Nükleer AŞ, geçtiğimiz hafta ÇED raporunu aldı. Halen inşaat lisansı bekleniyor.

Ama görünen o ki, nükleer hukuk alanındaki hazırlıkların tamamlanması, en az tesislerin kuruluşu kadar önemli.
